RETAIL PRICES (INTOXICATING LIQUOR) ORDER, 1997

RETAIL PRICES (INTOXICATING LIQUOR) ORDER, 1997

I, PAT RABBITTE, Minister of State at the Department of Enterprise and Employment, in exercise of the powers conferred on me by sections 22A and 22C (inserted by the Prices (Amendment) Act, 1965 (No. 23 of 1965)) of the Prices Act, 1958 (No. 4 of 1958), as amended by the Prices (Amendment) Act, 1972 (No. 20 of 1972), the Prices Stabilisation Order, 1973 ( S.I. No. 96 of 1973 ), the Industry and Commerce (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 19 of 1993 ), and the Enterprise and Employment (Delegation of Ministerial Functions) Order, 1995 ( S.I. No. 42 of 1995 ), hereby order as follows:

1. (1) This Order may be cited as the Retail Prices (Intoxicating Liquor) Order, 1997.

(2) This Order shall come into operation on the 11th of March 1997.

2. This Order shall apply to all areas in the State other than the areas comprising the county borough of Dublin, the administrative county of South Dublin, the administrative county of Fingal and the administrative county of Dun Laoghaire/Rathdown.

3. (1) Subject to paragraph (2) of this Article, this Order applies to the following intoxicating liquors--

( a ) draught stout, draught ale or draught lager sold by the int or half-pint,

( b ) stout, ale or lager sold by the pint bottle or the half-pint bottle,

( c ) whiskey or whisky sold by the glass or half glass,

( d ) gin sold by the glass or half glass,

( e ) vodka sold by the glass or half glass.

(2) This Order does not apply to the intoxicating liquors aforesaid when sold for consumption off the premises in which they are sold or when sold in premises registered under the Tourist Traffic Acts, 1939 to 1995.

4. The price charged in any particular part of any premises for intoxicating liquor to which this Order applies shall be the price obtaining for that liquor on the 4th day of November. 1996, in that part of those premises.

5. For the purpose of paragraph 4 of this Order, the price specified in respect of a particular intoxicating liquor in any notice under the Retail Price (Beverages in Licensed Premises) Display Order, 1976 ( S.I. No. 146 of 1976 ), displayed in any particular part of any premises on the 4th day of November, 1996, shall be deemed to be the price obtaining on that day for that intoxicating liquor in that part of those premises.

EXPLANATORY NOTE.

The effect of this Order, which shall apply from 4 March, 1997, to all areas of the State except the areas comprising the county borough of Dublin, the administrative county of South Dublin, the administrative county of Fingal and the administrative county of Dun Laoghaire/Rathdown, is to stipulate that the prices charged for intoxicating liquors indicated in any particular part of a licensed premises shall be the prices obtaining and displayed on 4 November, 1996.
