The Minister for Social Welfare, in exercise of the powers conferred on him by section 27 of the Social Welfare Act, 1997 (No. 10 of 1997), hereby orders as follows:

Citation

1. This Order may be cited as the Social Welfare Act, 1997 (Section 22(1) and (2)) (Commencement) Order, 1997.

Commencement

2. Section 22(1) and (2) of the Social Welfare Act, 1997 shall come into operation on the 4th day of June, 1997.

EXPLANATORY NOTE

This Order brings the provisions of subsections (1) and (2) of section 22 of the Social Welfare Act, 1997 into operation with effect from the 4th day of June, 1997.

These provisions provide for regulatory powers to extend entitlements to Disability Allowance to persons who reside in an institution otherwise than on a full-time basis and also provide that where one of a couple is in receipt of Disability Allowance and the other is in receipt of Old Age (non-contributory) Pension or Invalidity Pension, each of the couple may receive the full personal rate of payment.
