ORDER entitled NATIONAL CULTURAL INSTITUTIONS ACT, 1997 (COMMENCEMENT) (No. 2) ORDER, 1997

I, Síle de Valera, Minister for Arts, Heritage, Gaeltacht and the Islands, in exercise of the powers conferred on me by section 1 (4) of the National Cultural Institutions Act, 1997 (No. 11 of 1997 ) (as adapted by the Arts, Culture and the Gaeltacht (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 306 of 1997 ), hereby order as Allows:

1. This Order may be cited as the National Cultural Institutions Act, 1997 (Commencement) (No. 2) Order, 1997.

2. The 25^th day of July, 1997, is hereby fixed as the day on which the following provisions of the National Cultural Institutions Act, 1997 (No. 11 of 1997), shall come into operation, namely

( a ) section 4 (1), in so far as it relates to proceedings under section 49,

( b ) subsections (2) to (4) of section 4,

( c ) section 6(1), in so far as it relates to the repeal of section 24 of the National Monuments Act, 1930 .

( d ) section 46, and

( e ) in Part IV

(i) section 48, in so far as it relates to paintings in the care of the National Gallery,

(ii) paragraphs (d) and (e) of subsection (1) and subsections (3) and (6) to (13) of section 49, and

(iii) subsection (1), in so far as it relates to section 49(1)(d) and (e), and subsections (2) to (5) of section 50.

EXPLANATORY NOTE

This order brings into effect from 25th July, 1997 certain provisions of the National Cultural Institutions Act, including section 48 (register of important cultural objects) insofar as it concerns paintings in the care of the National Gallery of Ireland and section 46 (indemnities for certain items on the register) and certain subsections of sections 49 and 50 relating to the restriction on export and the export licence provisions for items on the register and archaeological objects.
