FREEDOM OF INFORMATION ACT, 1997 -- DELEGATION UNDER SECTION 4.

FREEDOM OF INFORMATION ACT, 1997 -- DELEGATION UNDER SECTION 4.

I, MICHAEL WOODS, Minister for the Marine and Natural Resources and head of the Department of the Marine and Natural Resources within the meaning of the Freedom of Information Act, 1997 , hereby delegate under section 4 of that Act:

to officers in the grades specified in Part 1 of Schedule 1, the functions specified in Part 2 of Schedule 1

and

to officers in the grades specified in Part 1 of Schedule 2, the functions specified in Part 2 of Schedule 2.

For the purposes of this delegation and the avoidance of doubt officers who are in receipt of a higher duties allowance for performing the duties of a grade specified in Schedule 1 or Schedule 2 of this Order are deemed to be officers in that grade.

SCHEDULE 1

PART 1

(i) each officer not lower than the grade of Higher Executive Officer;

(ii) each officer in grades in respect of which the maximum salary is not less than that of Higher Executive Officer.

PART 2

All functions other than those under Section 14.

SCHEDULE 2

PART 1

(i) each officer not lower than the grade of Assistant Principal officer;

(ii) each officer in grades in respect of which the maximum salary is not less than that of Assistant Principal officer.

All functions.

EXPLANATORY NOTE.

The order delegates to officers serving in specified grades in the Department of the Marine and Natural Resources decision making functions (as contained in Section 8 of the Freedom of Information Act, 1997 ) and internal review functions (as contained in Section 14 of the Act).
