EUROPEAN COMMUNITIES (MILK QUOTA) (AMENDMENT) REGULATIONS, 1998

I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Regulation (EEC) No. 3950/92 of 28 December, 1992 ¹, Council Regulation (EEC) No 2055/93 of 19 July 1993 ², Commission Regulation (EEC) No. 536/93 of 9 March 1993 ³ and Commission Regulation (EEC) No. 2562/93 of 17 September 1993 ⁴ hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Milk Quota)(Amendment) Regulations, 1998.

2. The European Communities (Milk Quota) Regulations, 1995 ( S.I. No. 266 of 1995 ), are hereby amended--

(a) by the insertion in Regulation 37.(1) after subparagraph (d) of the following subparagraph:

"(dd) remove any such records, books or documents and retain them for such period as may be reasonable,".

and

(b) by the insertion after Regulation 44 of the following Regulation:

"44A An offence under these Regulations may be prosecuted by the Minister.".

EXPLANATORY NOTE

This Order amends the European Communities (Milk Quota) Regulations, 1995, ( S.I. No. 266 of 1995 ), which put in place the arrangements for the operation of the milk quota system in Ireland in accordance with the European Communities (Milk Quota) Regulations Nos. 3950/92, 536/93, 2055/93 and 2562/93.

The amending Regulation provides for the removal by authorised officers of any records, books or documentation relating to milk or milk products and makes provision that an offence under the 1995 Regulations may be prosecuted by the Minister for Agriculture and Food.
