BYE-LAWS

FISHERY HARBOUR CENTRE (ROSSAVEEL) BYE-LAWS, 1999.

I, MICHAEL WOODS, T.D., Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by subsection (2)(a) of section 4 of the Fishery Harbour Centres Act, 1968 ( No. 18 of 1968 ), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 )), and after compliance with subsection (7) of that section, hereby make the following Bye-laws:

1. These Bye-laws may be cited as the Fishery Harbour Centre (Rossaveel) Bye-laws, 1999, and shall come into operation on the 28th day of July, 1999.

2. In these Bye-laws--

“length”, in relation to a passenger vessel, means the distance from the extreme forward point to the extreme after point of the vessel;

“passenger vessel” means a vessel which carries more than 12 fare-paying passengers;

“Rossaveel Fishery Harbour Centre” means the area declared by the Fishery Harbour Centre (Rossaveel) Order, 1981 ( S.I. No. 208 of 1981 ), to be a fishery harbour centre.

3. The master or person in charge of or operator of a passenger vessel of more than 40 metres in length shall not operate the vessel or take on board or disembark passengers from the vessel at the harbour at Rossaveel Fishery Harbour Centre.

4. The master or person in charge of or operator of a passenger vessel of 40 metres or less in length shall not operate the vessel or take on board or disembark passengers from the vessel at the harbour at Rossaveel Fishery Harbour Centre save under, and in accordance with any terms and conditions of, a permit in that behalf granted by the Minister.

5. The Fishery Harbour Centre (Rossaveel) Bye-laws, 1992, are hereby revoked.
