European Communities (Pig Carcase (Grading)) (Amendment) Regulations, 2001

I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 ( No. 27 of 1972 ) and for the purpose of giving effect to Commission Decisions 98/284/EC of 8 April 1998 (¹) and 2000/26/EC of 21 December 1999 (²) and Commission Regulation (EC) No. 3127/94 of 20 December 1994 (³) hereby make the following Regulations:

1.       (1)     These Regulations may be cited as the European Communities (Pig Carcase (Grading)) (Amendment) Regulations, 2001 and shall come into operation on the 10th day of September, 2001.

(2)     The European Communities (Pig Carcase (Grading)) Regulations, 1988 to 1994 and these Regulations may be cited together as the European Communities (Pig Carcase (Grading)) Regulations, 1988 to 2001.

2.        In these Regulations-

“the Principal Regulations” means the Pig Carcase (Grading) Regulations, 1988 ( S.I. No. 365 of 1988 ) as amended by-

•   the European Communities (Pig Carcase (Grading)) (Amendment) Regulations, 1993 ( S.I. No. 313 of 1993 ),

•   the European Communities (Pig Carcase (Grading)) (Amendment) (No. 2) Regulations, 1993 ( S.I. No. 405 of 1993 ) and

•   the European Communities (Pig Carcase (Grading)) (Amendment) Regulations, 1994 ( S.I. No. 216 of 1994 ).

3.       The Principal Regulations are hereby amended by -

(a)      the substitution in Regulation 3(1) in the definition of “the Commission Decision” for “and Commission Decision 94/362/EC of 20 June 1994” of “, Commission Decision 94/362/EC of 20 June 1994, Commission Decision 98/284/EC of 8 April 1998 and Commission Decision 2000/26/EC of 21 December 1999”.

(b)      the substitution in Regulation 3(1) in the definition of “the Council Regulations” for “and Council Regulation (EC) No. 3513/93 of 14 December 1993” of “, Council Regulation (EC) No. 3513/93 of 14 December 1993 and Commission Regulation (EC) No. 3127/94 of 20 December 1994”,

(c)      the deletion of “-- Introscope/midline” in Regulation 6,

(d)      the substitution in point 3 of Part I of the Annex for “ŷ = 50.16 - 0.772x₁ + 0.324x₂” of “ŷ = 60.91 - 0.839x₁ + 0.150x₂”,

(e)      the substitution in point 3 of Part 2 of the Annex for “ŷ = 53.41 - 0.786x₁ + 0.266x₂” of “ŷ = 60.30 - 0.847x₁ + 0.147x₂”

and

(f)       the deletion of Part 3 of the Annex.

These Regulations amend the Pig Carcase (Grading) Regulations, 1988 by introducing new formulae for calculating lean meat content and deleting references to the introscope/midline grading method.
