The Government, on the request of the Minister for Communications, Marine and Natural Resources and in exercise of the powers conferred on them by section 2 of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows: 1. This Order may be cited as the Marine (Delegation of Ministerial Functions) (No. 4) Order 2006. 2. The powers and duties of the Minister for Communications, Marine and Natural Resources conferred on him - |

(a) by or under Part 2 of the Maritime Safety Act 2005 (No. 11 of 2005), and |
|||||
(b) by or under Regulations 5,7,15(2)(b), 24 and 31 of the European Communities (Natural Habitats) Regulations 1997 ( S.I. No. 94 of 1997 ) relating to the Dumping at Sea Acts 1996 to 2006, the Fisheries Acts 1959 to 2006 or the Foreshore Acts 1933 to 2005, |

are delegated to John Browne, Minister of State at the Department of Communications, Marine and Natural Resources. |

The Government made this Order, with immediate effect, in favour of John Browne TD, Minister of State at the Department of Communications, Marine and Natural Resources, so as to delegate to him certain specified functions of the Minister for Communications, Marine and Natural Resources which have been transferred back to the Minister for Communications, Marine and Natural Resources from the Minister for Transport (to whom they were transferred in error on 1 January 2006 by the Maritime Transport, Safety and Security (Transfer of Departmental Administration and Ministerial Functions) Order 2005 ( S.I. No. 842 of 2005 )). |
