National Treasury Management Agency (Delegation of Functions) (Amendment) Order, 2007

The Government, in exercise of the powers conferred on them by section 9(5) of the National Treasury Management Agency (Amendment) Act 2000 (No. 39 of 2000), hereby order as follows:

1.        (1)      This Order may be cited as the National Treasury Management Agency (Delegation of Functions) (Amendment) Order 2007.

 (2)      This Order comes into operation on 8 May 2007.

2.        The National Treasury Management Agency (Delegation of Functions) Order 2003 ( S.I. No. 63 of 2003 ) is amended -

(a)      in Article 2 -

(i)       by the insertion of the following definition after the definition of �clinical claim�:

�eligible obstetricians� means obstetricians who, on or after 28 February 2001, are members of the Medical Protection Society, and who are entitled to apply to the Society for assistance (including indemnity) from the Special Fund (Private) or the Special Fund (Non-Private);�, and

(ii)      in the definition of �professional medical services�, by the substitution of the following subparagraph for subparagraph (a):

�(a)    services provided by registered medical practitioners or registered dentists of a diagnostic or palliative nature, or consisting of the provision of treatment, or the conduct of research in respect of any illness, disease, injury or other medical condition,�,

(b)      in Article 3 -

(i)       in clause II of subparagraph (iii) of paragraph (a), by the substitution of �place,� for �place, or�,

(ii)      in subparagraph (iv) of paragraph (a), by the substitution of �Order,� for �Order, and�, and

(iii)      by the insertion of the following subparagraphs after sub paragraph (iv) of paragraph (a):

�(v)      University College Dublin, relating to the provision of, or failure to provide, a professional medical service at the National Virus Laboratory at University College Dublin,

(vi)       Mount Carmel Medical Group (Dublin South) Limited, relating to the provision of, or failure to provide, a professional medical service at the obstetrics department at Mount Carmel Hospital,

(vii)      The Bon Secours Health System Limited, relating to the provision, of or failure to provide, a professional medical service at the obstetrics department at the Bon Secours Hospital Cork,

(viii)     The Royal College of Surgeons in Ireland, relating to the provision of, or failure to provide, a professional medical service at the Royal College of Surgeons in Ireland pathology department at Beaumount Hospital, or,

(ix)      eligible obstetricians, relating to the provision of, or failure to provide a professional medical service in private or non-private practice in the State, and�,

(c)      in column (1) of Part I of Schedule 1, by the substitution of �Mercy Hospital Limited� for �Mercy Hospital�,

(d)      by the insertion in the said Part 1, of the text set out in Part A of the Schedule to this Order,

(e)      by the insertion in the said Part 1, of the text set out in Part B of the Schedule to this Order,

and

(f)      by the insertion in Schedule 2, of the State authorities specified in Part B of the Schedule to this Order.
