CIVIL REGISTRATION (MARRIAGES) (FEES) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

�Iris Oifigi�il� of 13th November, 2007.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by sections 3, 46(3), 61, and 67 of the Civil Registration Act 2004 (No. 3 of 2004) hereby make the following regulations:

1. (1) These Regulations may be cited as the Civil Registration (Marriages) (Fees) Regulations 2007.

(2) These Regulations come into operation on 5 November 2007.

2. In these Regulations, unless the context otherwise requires-

�Act� means the Civil Registration Act 2004 (No. 3 of 2004);

�register� means the register of marriages established and maintained under and in accordance with section 13(1)(e) of the Act;

�search dates� means the date on which the search for an entry in the register, or an index to the register, is to commence and to end.

3. For the purposes of sections 61(1)(b) and 61(2)(b) of the Act-

(a) the amount of �8 is prescribed as the fee for the giving of each copy of an entry in the register that is certified to be a true copy of that entry, and

(b) the amount of �4 is prescribed as the fee for the giving of each copy of an entry in the register.

4. For the purposes of a search referred to in section 61(1)(a) of the Act-

(a) the amount of �2 is prescribed as the fee for a search if the period of time within the search dates specified for the search is 5 years or less, and

(b) the amount of �20 is prescribed as the fee for a search if the period of time within the search dates specified for the search is greater than 5 years and the time taken to conduct that search does not exceed 7 consecutive hours.

5. The amount of �2 is prescribed as the fee for a search under section 61(2)(a) of the Act.

6. The amount of �150 is prescribed as the fee for the purposes of section 46(3) of the Act.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The effect of this Order is to allow certain increases in the fees payable to (a) Oifig An Ard-Chl�raitheora (b) Superintendent Registrars and (c) Registrars of Births, Deaths and Marriages for searches, certificates and other registration services in the matter of the civil registration of marriages.
