THOROUGHBRED FOAL LEVY REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

�Iris Oifigi�il� of 8th January, 2008.

Horse Racing Ireland, in exercise of the powers conferred on it by section 38A (inserted by section 5 of the Horse and Greyhound Racing (Betting Charges and Levies) Act 1999 (No. 24 of 1999) of the Irish Horseracing Industry Act 1994 (No. 18 of 1994) and the Horse and Greyhound Racing (Transfer of Departmental Administration and Ministerial Functions) Order 2002 (S. I. No. 297 of 2002) (as adapted by the Tourism, Sport and Recreation (Alteration of Name of Department and Title of Minister) Order 2002 (S. I. No. 309 of 2002)), with the consent of the Minister for Arts, Sport and Tourism, hereby makes the following regulations:

1. (1) These Regulations may be cited as the Thoroughbred Foal Levy Regulations 2007.

(2) These Regulations come into operation on 1 January 2008.

2. In these Regulations-

�advertised value of the nomination fee� means the value of the nomination fee for a particular stallion which is deemed by HRI, following consultation with the owner of the stallion, as being generally applicable for a covering of a mare by that stallion on 15 February in the year prior to the year of birth of the foal by that stallion;

�owner of a thoroughbred foal� means the person who submits the registration form for a thoroughbred foal for registration in the stud book;

�registered stallion� means a stallion registered as breeding stock with Weatherbys in the stud book for the year prior to the year of birth of the foal by that stallion as advised to HRI by Weatherbys;

�stud book� means that part of the General Stud Book of Great Britain and Ireland which is maintained by Weatherbys;

�Weatherbys� means Weatherbys Ireland GSB Limited.

3. Levy is payable on all thoroughbred foals registered in the stud book-

(a) where the foal�s sire is a registered stallion, at the rate specified in column (3) opposite the advertised value of the nomination fee of the stallion mentioned in column (1) and the rate band mentioned in column (2), of the Table to this Regulation, or

(b) where the foal�s sire is not a registered stallion, at the standard rate of �231.

4. (1) Levy is payable, for and on behalf of Horse Racing Ireland, to Weatherbys.

(2) Levy must be paid to Weatherbys at the time of application for registration of the foal in the stud book with the stud book registration form in respect of the foal.

5. The following are revoked:

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The Foal Levy Committee (comprising nominees from the Irish Thoroughbred Breeders Association, the Irish Farmers Association and Horse Racing Ireland) and the HRI Board have agreed to the annual application of inflationary type increases to the Thoroughbred Foal Levy to contribute to the increasing costs, level of services and funding requirements of the primary beneficiaries.
