S.I. No. 402/2010 - Road Traffic (Recognition of Foreign Driving Licences - New Zealand and Taiwan) Order 2010.

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 24th August, 2010.

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 23A (inserted by section 8 of the Road Traffic Act 2006 (No. 23 of 2006)) of the Road Traffic Act 1961 (No. 24 of 1961) and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )) hereby order as follows:

1. This Order may be cited as the Road Traffic (Recognition of Foreign Driving Licences - New Zealand and Taiwan) Order 2010.

2. It is declared that a licence or permit permitting a person to drive a mechanically propelled vehicle, not being a licence or permit issued to a person to enable that person to learn or provisionally to drive such a vehicle, issued by the competent authority of New Zealand or the Republic of China (Taiwan) in a category which corresponds to categories A, A1, B, M and W in the Table to Regulation 6 of the Road Traffic (Licensing of Drivers) Regulations 2006 ( S.I. No. 537 of 2006 ) is recognised for the purpose of exchange of that licence or permit for a driving licence.

3. This Order does not apply to a licence or permit issued by the competent authority of New Zealand or the Republic of China (Taiwan) in exchange for a licence or permit issued by a state, other than the State, which is not another Member State or a state mentioned in the Schedule to the Road Traffic (Recognition of Foreign Driving Licences) Order 2007 ( S.I. No. 527 of 2007 ).

4. (a) As respect licences issued by New Zealand, subject to paragraph (b), a driving licence being granted in exchange for such a licence shall only give entitlement to drive an automatic drive vehicle in the category concerned.

(b) Subject to paragraph (c), where the New Zealand licensing competent authority confirms that the person exchanging a New Zealand driving licence or permit under these Regulations completed a test in a manual drive vehicle which is considered to demonstrate the necessary ability to drive the vehicle to the satisfaction of the Road Safety Authority, the licence issued on exchange shall not be restricted to entitlement to drive automatic vehicles.

(c) Paragraph (b) does not apply where subsequent to the test, the New Zealand licensing authorities issued the person with a licence which only gives entitlement to drive an automatic drive vehicle in the category concerned.

(This note is not part of the Instrument and does not purport to be a legal interpretation).

The purpose of this order is to extend recognition of driving licences (with certain qualifications), for the purposes of exchange for Irish driving licences, to driving licences issued by the competent authorities of New Zealand and the Republic of China (Taiwan).
