S.I. No. 473/2010 - Health Professionals (Reduction of Payments to Consultant Psychiatrists) Regulations 2010.

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 5th October, 2010.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 9 of the Financial Emergency Measures in the Public Interest Act 2009 (No. 5 of 2009), having complied with subsections (4), (7) and (13) of that section, with the consent of the Minister for Finance, hereby make the following regulations:

1. These Regulations may be cited as the Health Professionals (Reduction of Payments to Consultant Psychiatrists) Regulations 2010.

2. These Regulations shall apply to payments in respect of services rendered by a consultant psychiatrist to or on behalf of the Mental Health Commission.

3. The amount of a payment that shall be made to a consultant psychiatrist in respect of a service referred to in Regulation 2 from the date of the making of these Regulations shall be as set out in the Schedule.

4. The Health Professionals (Reduction of Payments to Consultant Psychiatrists) Regulations 2009 ( S.I. No. 172 of 2009 ) are revoked.

SCHEDULE

PAYMENTS TO CONSULTANT PSYCHIATRISTS

AMOUNT

Fee payable to a consultant psychiatrist for serving as a member of a tribunal appointed under section 48 of the Mental Health Act 2001 (No. 25 of 2001) for a matter referred to the tribunal under that Act

Fee payable to a consultant psychiatrist for serving as a member of a tribunal appointed under section 48 of the Mental Health Act 2001 where a scheduled sitting of the tribunal is cancelled-(1) with 3 working days notice(2) with 2 working days notice(3) on the day of the sitting

Fee payable to a consultant psychiatrist in respect of services provided pursuant to a direction under section 17(1)(c) of the Mental Health Act 2001

Fee payable to a consultant psychiatrist in respect of services provided pursuant to a direction under section 17(1)(c) of the Mental Health Act 2001 with regard to a patient where the matter does not proceed to a sitting of the tribunal appointed under section 48 of that Act in respect of the patient concerned for services rendered for-(1) an examination of the patient(2) an interview with the consultant psychiatrist responsible for the care and treatment of the patient(3) a review of records relating to the patient
