Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 29th June, 2012.

I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by Section 18 of the Section 4 of the Water Services (Amendment) Act 2012 (No. 2 of 2012), hereby make the following Regulations:

Citation

1. These Regulations may be cited as the Domestic Waste Water Treatment Systems (Registration) Regulations 2012.

Interpretation

2. In these Regulations-

"Act" means the Water Services (Amendment) Act 2012 (No. 2 of 2012);

"Application" means an application for registration for the purpose of Section 70B(2) of the Act.

Registration Date

3. The 1st February 2013 is appointed as the prescribed date for the purposes of Section 70B(2) of the Act.

Fee Payable

4. The fee to be prescribed under Section 70B(3)(e) of the Act is €5 where application is made on or before the 28th September 2012 and €50 thereafter.

Application for Registration

5. (1) An application shall be made to the relevant water services authority in writing, or electronically via www.protectourwater.ie

(2) An application shall contain the following information:

(a) the name of the owner of the premises connected to a domestic waste water treatment system,

(b) the correspondence address of the owner of such premises,

(c) the address (and if necessary further information including a description) of the premises connected to a domestic waste water treatment system, if different from that at (b).

Method by which payment shall be made

6. (1) The following means of payment are prescribed for the purposes of Section 70B(3)(e) of the Act:

(a) where application is made in writing, by cheque, bank draft, postal order or credit or debit card;

(b) where application is made in writing and payment of the registration fee is made in person to a water services authority, by cheque, bank draft, postal order, credit or debit card or by cash payment;

(c) where application is made by way of the internet, by credit or debit card.

(2) Payment of the registration fee shall in all cases be made in the currency of the State.

The purpose for which these Regulations are made is to prescribe the following:

1. The date by which an owner of a premises connected to a domestic waste water treatment system must effect registration of the system with the relevant water services authority,

2. The fee to accompany an application for registration, and

3. The information which must be provided on application.
