Notice of the making of this Statutory Instrument was published in

I, Simon Coveney, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving further effect to Council Directive No. 92/43/EEC of 21 May 1992¹ (as amended by Council Directive No. 97/62/EC of 27 October 1997² , Regulation (EC) No 1882/2003 of the European Parliament and of the Council of 29 September 2003³ and Council Directive No. 2006/105/EC of 20 November 2006⁴ and Directive 2009/147/EC of the European Parliament and of the Council of 30 November 2009⁵ , so far as those Directives relate to the impact of sea-fisheries on the marine environment, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Control on Mussel Fishing) Regulations 2008 (Amendment) Regulations 2012.

2. The Schedule to the European Communities (Control on Mussel Fishing) Regulations 2008 ( SI No. 347 of 2008 ) (as amended by the European Communities (Control on Mussel Fishing) Regulations 2008 (Amendment) Regulations 2011 ( S.I. No. 402 of 2011 )) is amended by-

(a) substituting paragraph (i) for the following-

"(i) within an imaginary line drawn from Latitude 52 degrees 59 minutes 18 seconds North, Longitude 5 degrees 59 minutes 24 seconds West through Latitude 52 degrees 59 minutes 18 seconds North, Longitude 5 degrees 55 minutes 18 seconds West through Latitude 52 degrees 57 minutes 30 seconds North, Longitude 5 degrees 55 minutes 18 seconds West through Latitude 52 degrees 57 minutes 30 seconds North, Longitude 5 degrees 59 minutes 24 seconds West to Latitude 52 degrees 59 minutes 18 seconds North, Longitude 5 degrees 59 minutes 24 seconds West," and

(b) substituting paragraph (l) for the following-

"(l) within an imaginary line drawn from Latitude 52 degrees 21 minutes 36 seconds North, Longitude 6 degrees 17 minutes West", through Latitude 52 degrees 21 minutes 36 seconds North, Longitude 6 degrees 15 minutes 36 seconds West, through 52 degrees 14 minutes 48 seconds North, Longitude 6 degrees 15 minutes 36 seconds West, through Latitude 52 degrees 15 minutes 12 seconds North, Longitude 6 degrees 17 minutes 30 seconds West through Latitude 52 degrees 16 minutes 12 seconds North, Longitude 6 degrees 19 minutes West to Latitude 52 degrees 21 minutes 36 seconds North, Longitude 6 degrees 17 minutes West,".

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation).

These Regulations are to provide for the closure of some areas for mussel seed fishing having regard to the need to protect the environment.
