I, JAMES REILLY, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 76/768/EEC of 27 July 1976¹ , as amended by Commission Implementing Directive 2012/21/EU of 2 August 2012² , hereby make the following regulations:

Citation

1. These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment) (No. 2) Regulations 2013.

Collective citation

2. The Principal Regulations and these Regulations may be cited together as the European Communities (Cosmetic Products) Regulations 2004 to 2013 and shall be construed together as one.

Interpretation

3. In these Regulations, “Principal Regulations” means the European Communities (Cosmetic Products) Regulations 2004 ( S.I. No. 870 of 2004 ) as amended.

Amendment of the European Communities (Cosmetic Products) Regulations 2013

4. The preamble to the European Communities (Cosmetic Products) Regulations 2013 ( S.I. No. 161 of 2013 ) is amended by substituting “Directive 2012/21/EU” for “Directive 2012/12/EU”.

Amendment of Regulation 4(1) of the Principal Regulations

5. The definition of “Directive” in Regulation 4(1) of the Principal Regulations (as amended by the European Communities (Cosmetic Products) (Amendment) Regulations 2013 ( S.I. No. 161 of 2013 )), is amended by substituting “Directive 2012/21/EU” for “Directive 2012/12/EU”.

EXPLANATORY NOTE

These Regulations amend the European Communities (Cosmetic Products) Regulations 2004 and the European Communities (Cosmetic Products) (Amendment) Regulations 2013 to correct a typographical error in the title of the Commission Implementing Directive 2012/21/EU of 2 August 2012.
