I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to Council Directive 92/43/EEC of 21 May 1992¹ (as amended by Council Directive 97/62/EC of 27 October 1997² , Regulation (EC) No. 1882/2003 of the European Parliament and of the Council of 29 September 2003³ and Council Directive 2006/105/EC of 20 November 2006⁴ and Directive 2009/147/EC of the European Parliament and of the Council of 30 November 2009⁵ (as amended by Council Directive 2013/17/EU of 13 May 2013⁶ ), hereby make the following regulations:

1. These regulations may be cited as the European Communities (Control on Mussel Fishing) Regulations 2008 (Revocation) Regulations 2013.

2. The following Regulations are revoked-

(a) European Communities (Control on Mussel Fishing) Regulations 2008 ( S.I. No. 347 of 2008 ) other than Regulation 8,

(b) European Communities (Control on Mussel Fishing) (Amendment) 2009 ( S.I. No. 108 of 2009 ),

(c) European Communities (Control on Mussel Fishing) Regulations 2008 (Amendment) Regulations 2011 ( S.I. No. 402 of 2011 ), and

(d) European Communities (Control on Mussel Fishing) Regulations 2008 (Amendment) Regulations 2012 ( S.I. No. 366 of 2012 ).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This SI revokes the European Communities (Control on Mussel Fishing) Regulations 2008 as amended except for Regulation 8. The 2008 Regulations prohibited mussel fishing in certain specified areas.
