I, ENDA KENNY, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving full effect to Regulation (EC) No. 437/2003 of the European Parliament and of the Council of 27 February 20031 , as last amended by Commission Regulation (EC) No. 546/2005 of 8 April 20052 , hereby order as follows: |
||
1. (1) This Order may be cited as the Statistics (Carriage of Passengers, Freight and Mail by Air) Order 2013. |
||
(2) This Order comes into operation on 1 January 2014. |
||
2. (1) In this Order- |
||
"Annex" means Annex I to the European Parliament and Council Regulation; |
||
"European Parliament and Council Regulation" means Regulation (EC) No. 437/2003 of the European Parliament and of the Council of 27 February 20031, as amended by Commission Regulation (EC) No. 1358/2003 of 31 July 20033 (as amended by Commission Regulation (EC) No. 158/2007 of 16 February 20074 ) and Commission Regulation (EC) No. 546/2005 of 8 April 20052. |
||
(2) A word or expression that is used in this Order and is also used in the European Parliament and Council Regulation has, unless the contrary intention appears, the same meaning in this Order as it has in that Regulation. |
||
3. This Order applies to an airport referred to in the Schedule. |
||
4. The authority that for the time being manages an airport is prescribed as an undertaking required to provide the office with information- |
||
(a) the general nature of which is specified in Article 5, |
||
(b) at a frequency which is specified in Article 5, and |
||
(c) within the period specified in Article 6, |
||
and subsequent references in this Order to an airport shall be read as references to that authority. |
||
5. (1) An airport shall, in respect of each month, provide to the office information relating to flight stage, on flight origin and destination data for commercial air services provided by airlines at that airport in accordance with Tables A and B of the Annex. |
||
(2) An airport shall, in respect of each year, provide to the office information relating to aircraft movements at that airport and passengers carried, freight and mail loaded onto, or unloaded from, aircrafts at that airport in accordance with Table C of the Annex. |
||
6. (1) An airport shall, in respect of the month concerned, provide to the office the information specified in Article 5(1) not later than 4 months after the last day of that month. |
||
(2) An airport shall, in respect of each year concerned, provide to the office the information specified in Article 5(2) not later than 4 months after the last day of that year. |
||
7. (1) Subject to paragraph (2), an undertaking required by this Order to provide information to the office shall provide such information- |
||
(a) by the completion of forms and questionnaires prepared by the Director General in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993), and |
||
(b) where directions under section 26 of that Act have been given to the undertaking, in accordance with those directions. |
||
(2) An undertaking required by this Order to provide information shall be deemed to comply with that obligation where, with the consent of the Director General, the information is furnished by electronic means, provided that the Director General approves the format or manner in which the information is provided. |
||
8. The European Communities (Statistics In Respect of Carriage of Passengers, Freight and Mail by Air) Regulations 2008 ( S.I. No. 56 of 2009 ) are revoked. |
