I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive 2013/45/EU of 7 August 20131 , hereby make the following regulations: |
||
|
1. These Regulations may be cited as the European Communities (Vegetable Seeds) (Amendment) Regulations 2014. |
||
|
2. The European Communities (Vegetable Seeds) Regulations 2001 ( S.I. No. 306 of 2001 ) are amended by- |
||
|
(a) substituting in Regulation 2 (1) the definition of- |
||
|
(i) "Annex I" for the following- |
||
|
"’Annex I’ means Annex I to the Directive;", |
||
|
(ii) "Annex II" for the following- |
||
|
"’Annex II’ means Annex II to the Directive;", |
||
|
(iii) "Annex III" for the following- |
||
|
"’Annex III’ means Annex III to the Directive;", |
||
|
(iv) "Annex IV" for the following- |
||
|
"’Annex IV’ means Annex IV to the Directive;", |
||
|
(v) "Annex V" for the following- |
||
|
"’Annex V’ means Annex V to the Directive;", |
||
|
(vi) "EC Directive" (as amended by the European Communities (Vegetable Seed) (Amendment) Regulations 2005 ( S.I. No. 920 of 2005 )) for the following- |
||
|
"‘Directive’ means Commission Directive No. 2002/55/EC of 13 June 20022 as amended by Council Directive 2003/61/EC of 18 June 20033 , Regulation (EC) 1829/2003 of the European Parliament and of the Council of 22 September 20034 , Council Directive 2004/117/EC of 22 December 20045 , Commission Directive 2006/124/EC of 5 December 20066 , Commission Directive 2009/74/EC of 26 June 20097 and Commission Implementing Directive 2013/45/EU of 7 August 2013", |
||
|
(b) in Regulation 6A(3)(b) (as substituted by the European Communities (Vegetable Seed) (Amendment) Regulations 2005) substituting "EC Directive" for "directive", |
||
|
(c) deleting Regulation 25, |
||
|
(d) in Regulation 26 (inserted by the European Communities (Vegetable Seed) (Amendment) Regulations 2005) substituting "EC Directive" for "directive" in each place it occurs, and |
||
|
(e) deleting the Schedule. |
||
|
3. A reference in the European Communities (Vegetable Seeds) Regulations 2001 to- |
||
|
(a) Article 11 of Council Directive 70/458/EEC of 29 September 1970 shall be construed as a reference to Article 10 of the directive; |
||
|
(b) Article 32 of Council Directive 70/458/EEC of 29 September 1970 shall be construed as a reference to Article 37 of the directive; |
||
|
(c) Article 37 of Council Directive 70/458/EEC of 29 September 1970 shall be construed as a reference to Article 41 of the directive; |
||
|
(d) Article 39 of Council Directive 70/458/EEC of 29 September 1970 shall be construed as a reference to Article 36 of the directive; |
||
|
(e) Article 40 of Council Directive 70/458/EEC of 29 September 1970 shall be construed as a reference to Article 46(1),(3) and (4) of the directive |
||
|
in each place where it occurs. |
||
|
|
||
|
