I, PASCHAL DONOHOE, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 1 (2) of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012) and section 26 (2) of the Road Traffic Act 2002 (No. 12 of 2002) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby order as follows: |

1. This Order may be cited as the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (Commencement) (Penalty Points - Certificate of Road Worthiness) Order 2014. |
||
2. The day fixed as the day on which section 44 (a) and (b) of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012) and the matter at reference number 2A (inserted by the said section 44(b)) in Part 1 of the First Schedule to the Road Traffic Act 2002 (No. 12 of 2002) come into operation is 17th November 2014. |

EXPLANATORY NOTE |

This order commences the insertion into Part 1 of the First Schedule of the Road Traffic Act 2002 a reference at number 2A for the offence of using a vehicle without a certificate of roadworthiness. Commitment of this offence will result in a direct summons to court, and on conviction an endorsement of 5 penalty points on the offender’s driving licence. |
||
Previously an offence consisting of contravention of Regulation 19 of EC (Vehicle Testing) Regulations 2004, using a vehicle without a certificate of roadworthiness is now an offence under Section 6 (2) of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 . |
