Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 3rd July, 2015.

I, LEO VARADKAR, Minister for Health, in exercise of the powers conferred on me by section 4 5A(7) (inserted by section 4 of the Health Act 2008 ) (No. 21 of 2008) of the Health Act 1970 (No. 1 of 1970) hereby make the following Regulations:

1. (1) These Regulations may be cited as the Health Act 1970 (Section 45A(7)) (Classes of Payments) Regulations 2015.

(2) These Regulations shall come into operation on 1 July 2015.

2. The following classes of payments are prescribed for the purposes of section 4 5A(7) (inserted by section 4 of the Health Act 2008 ) (No. 21 of 2008) of the Health Act 1970 (No. 1 of 1970):

(a) a payment or payments made to a person under the Scheme made by the Government in December 2013 and for the time being administered by the Minister for Justice and Equality, providing for the making of ex-gratia payments to women who were admitted to and worked in a relevant institution, within the meaning of the Redress for Women Resident in Certain Institutions Act 2015 (No. 8 of 2015);

(b) any subsequent income from the investment of the monies arising from a payment or payments referred to in paragraph (a).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order provides that any sums received by way of payments which have been determined in accordance with the Magdalen Commission Report for the benefit of women who were admitted to and worked in the Magdalen Laundries and two similar institutions will be disregarded in the calculation of gross income for eligibility for health services under section 45A and section 45(5A) of the Health Act 1970 .
