I, LEO VARADKAR, Minister for Health, in exercise of the powers conferred on me by sections 2 and 15 of the Public Health (Sunbeds) Act 2014 (No. 12 of 2014), hereby make the following regulations: |
||
1. These Regulations may be cited as the Public Health (Sunbeds) (Health Information) (Amendment) Regulations 2015. |
||
2. In these Regulations “Principal Regulations” means the Public Health (Sunbeds) (Health Information) Regulations 2015 ( S.I. No. 50 of 2015 ). |
||
3. Regulation 5 of the Principal Regulations is amended by inserting after paragraph (2) the following paragraphs: |
||
“(3) The form set out in Schedule 3 is prescribed, for the purposes of section 15(2)(c) of the Act, as the form to confirm- |
||
(a) that a person who is illiterate or blind has been provided with a copy of the information prescribed under Regulation 4, |
||
(b) that such person has had that information read to him or her by the owner, manager or employee of the sunbed business, and has had an opportunity to consider the information, each time he or she proposes to use, hire or purchase a sunbed, and |
||
(c) that such person made his or her signature or mark confirming compliance with subparagraphs (a) and (b) in the presence of the owner, manager or employee of the sunbed business. |
||
(4) The form prescribed in paragraph (3) shall- |
||
(a) contain the text set out in Schedule 3, |
||
(b) be printed on white paper or white cardboard, and |
||
(c) be printed in black indelible ink, verdana typeface and a font size of at least 14.” |
||
4. The Principal Regulations are amended by substituting the following for Schedule 2: |

5. The Principal Regulations are amended by inserting after Schedule 2 the following Schedule: |

This form must be signed or marked each time by the person proposing to use, hire or purchase a sunbed, and each time must be completed by the owner, manager or employee of the sunbed business in whose presence the signature or mark of such person is made |

I confirm that I have been provided with a copy of the prescribed information, have had that information read to me by the owner, manager or employee of the sunbed business and have had an opportunity to consider it. |
