I, LEO VARADKAR, Minister for Health, in exercise of the powers conferred on me by sections 2 and 9 (2) of the Public Health (Sunbeds) Act 2014 (No. 12 of 2014), hereby make the following regulations: |
||
1. These Regulations may be cited as the Public Health (Sunbeds) (Prohibition of Certain Marketing Practices) (Amendment) Regulations 2015. |
||
2. The Public Health (Sunbeds) (Prohibition of Certain Marketing Practices) Regulations 2015 ( S.I. No. 51 of 2015 ) are amended by inserting after Regulation 9 the following Regulations: |
||
“10.(1) A person shall not- |
||
(a) advertise or promote, or cause to be advertised or promoted, or |
||
(b) make available, or cause to be made available, |
||
a sunbed, or the use of a sunbed, on a sunbed premises, on the condition that the sunbed is used or made available for a minimum period of time greater than one minute. |
||
(2) In paragraph (1), ‘minimum period of time’ includes a period of time divided into two or more sessions in which a sunbed is used or made available. |
||
11. (1) Subject to paragraph (2), a person shall not advertise or promote, or cause to be advertised or promoted, a sunbed, or the use of a sunbed, on a sunbed premises, for a period of time greater than one minute without providing the price per minute of such sunbed in such advertisement or promotion. |
||
(2) In the case of a printed or written advertisement or promotion, whether in physical or electronic form, a person shall not be in compliance with paragraph (1) unless the price per minute is printed or written in the same font, colour and size as the price that applies in respect of the greater period of time referred to in that paragraph.” |

These Regulations amend the Public Health (Sunbeds) (Prohibition of Certain Marketing Practices) (Amendment) Regulations 2015 to prohibit the use of a sunbed from being advertised, promoted or made available on condition that the sunbed is used or made available for a minimum period of time greater than one minute. This practice is prohibited for the purpose of protecting public health and in particular for the purpose of reducing the risk to health arising from the use of sunbeds. |

These Regulations may be cited as the Public Health (Sunbeds) (Prohibition of Certain Marketing Practices) (Amendment) Regulations 2015. |
