I, JAN OSULLIVAN, Minister for Education and Skills, in exercise of the powers conferred on me by section 53 (amended by section 7 of the Education (Miscellaneous Provisions) Act 2015 (No. 11 of 2015)) of the Education Act 1998 (No. 51 of 1998) (as adapted by the Education and Science (Alteration of Name of Department and Title of Minister) Order 2010 ( S.I. No. 184 of 2010 )), and following consultation with the Minister for Public Expenditure and Reform, hereby make the following regulations: |

1. These Regulations may be cited as the Education Act 1998 (Section 53) (Prescribed Public Bodies) Regulations 2015. |
||
2. These Regulations shall come into operation on 11 August 2015. |
||
3. The public bodies specified in the Schedule are prescribed for the purposes of section 53 (amended by section 7 of the Education (Miscellaneous Provisions) Act 2015 (No. 11 of 2015)) of the Education Act 1998 (No. 51 of 1998). |

That part of St. Patrick’s College Drumcondra which is known as the Educational Research Centre and is a constituent part of St. Patrick’s College Drumcondra (hereinafter referred to as “ERC-St. Patrick’s College”) or any body established under section 54 of the Education Act 1998 which assumes the functions of ERC-St. Patrick’s College |

EXPLANATORY NOTE |

(This note is not part of the Instrument and does not purport to be a legal interpretation.) |

Section 7 of the Education (Miscellaneous Provision) Act 2015 provides for a refusal of access to specified information through an amendment of section 53 of the Education Act 1998 (as amended by Section 5 of the Education (Miscellaneous Provision) Act 2007). The Minister may refuse access to specified information and any public body prescribed by the Minister following consultation with the Minister of Public Expenditure and Reform shall refuse access to specified information unless consented to or directed by the Minister. These regulations designate the public bodies set out in the schedule as the “prescribed bodies”. |
