Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th February, 2015.

The Minister for the Environment, Community and Local Government, in exercise of the powers conferred on him by sections 3 and 43 (inserted by section 62 of the section 115 of the sections 4 and 62 of the Local Government Reform Act 2014 (No. 1 of 2014) and with the consent of the Minister for Public Expenditure and Reform, hereby orders as follows:-

Citation and construction

1. This Order may be cited as the Local Government Act 1991 (Regional Assemblies) (Establishment) (Amendment) Order 2015.

2. The Principal Order and this Order may be cited as the Local Government Act 1991 (Regional Assemblies) (Establishment) Orders 2014 and 2015 and shall be construed together as one.

Interpretation

3. In this Order “Principal Order” means the Local Government Act 1991 (Regional Assemblies) (Establishment) Order 2014 ( S.I. No. 573 of 2014 ).

Amendments to the Principal Order

4. ThePrincipal Order is amended-

(a) in Article 30 by substituting “Article 29,” for “this Article,”,

(b) in Article 32(1)-

(i) by substituting “Where a member of a constituent local authority is appointed as a member or as an alternate member of the Committee of the Regions” for “Where a member of a constituent local authority is appointed as a member of the Committee of the Regions”, and

(ii) by deleting after “under” the word “the”,

(c) in Article 32(2) by substituting “subject to him or her remaining a member or an alternate member of the Committee of the Regions.” for “subject to him or her remaining a member of the Committee of the Regions.”,

(d) in Article 32(4) by substituting “alternate member of” for “alternate to”,

and

(e) in Article 52(10) by substituting “The director shall support regional assembly members in their role as members or alternate members of the Committee of the Regions” for “The director shall support regional assembly members in their role as members of the Committee of the Regions”.

EXPLANATORY NOTE

This Order amends the Local Government Act 1991 (Regional Assemblies) (Establishment) Order 2014 ( S.I. No. 573 of 2014 ) to provide that alternate members of the Committee of the Regions become members of the relevant regional assembly, if they are not already members.
