Notice of the making of this Statutory Instrument was published in | ||
“Iris Oifigiúil” of 17th June, 2016. | ||
I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 34 and 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following regulations: | ||
1. These Regulations may be cited as the Animal Health and Welfare (Bovine Tuberculosis) (Amendment) Regulations 2016. | ||
2. The Animal Health and Welfare (Bovine Tuberculosis) Regulations 2015 ( S.I. No. 58 of 2015 ) are amended by substituting— | ||
(a) in Regulation 2(1), the definition of “herdowner” for the following— | ||
“’herdowner’ means a person who has a beneficial interest in a herd and has registered that interest in accordance with Regulation 3;”, | ||
(b) Regulation 22(1) for the following- | ||
“(1) Subject to paragraph (2), the Minister may pay, following a direction under section 30 of the Act for the purposes of bovine tuberculosis, an amount not exceeding— | ||
(a)€3,000 in respect of a bovine, and | ||
(b)€4,000 in respect of one stock bull or €5,000 in respect of one pedigree stock bull, | ||
on foot of a declaration made under Regulation 13(1)(a) or (2)(a).”, | ||
(c) by inserting after Regulation 22(3) the following— | ||
“(4) In this Regulation “stock bull” means an adult bull that is kept for breeding within an epidemiological unit on the holding that is subject to a declaration made under Regulation 13(1)(a) or (2)(a).”, and | ||
(d) by substituting Regulation 31 for the following— | ||
“31. Regulations 3, 4, 7, 8 (1), 8(2), 8(3)(b), 8(4), 8(5), 8(6), 8(7), 8(8), 9, 10, 11, 13, 14, 15, 16, 19, 20, 21, 24, 25, 26, 28, 29 and 30 are penal provisions to which paragraph (b) of section 36(4) of the Act applies.”. | ||

These Regulations amend S.I. Number 58 of 2015 and in particular provide for compensation to be paid for the purposes of bovine tuberculosis in respect of a bovine up to the value of €3,000 and up to €4,000 in respect of one stock bull or €5,000 in respect of one pedigree stock bull. |
