I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purposes of giving effect to Commission Directive 2014/100/EU of 28 October 2014¹ , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Vessel Traffic Monitoring and Information System) (Amendment) Regulations 2016.

2. Regulation 2 of the European Communities (Vessel Traffic Monitoring and Information System) Regulations 2010 ( S.I. No. 573 of 2010 ) is amended by substituting for the definition of “Directive” the following:

“ ‘Directive’ means Directive No. 2002/59/EC of the European Parliament and of the Council of 27 June 2002² , as amended by—

(a) Directive 2009/17/EC of the European Parliament and of the Council of 23 April 2009³ ,

(b) Directive No. 2009/18/EC of the European Parliament and of the Council of 23 April 2009⁴ ,

(c) Commission Directive 2011/15/EU of 23 February 2011⁵ , and

(d) Commission Directive 2014/100/EU of 28 October 2014¹;”.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation thereof.)

These Regulations amend the European Communities (Vessel Traffic Monitoring and Information System) Regulations 2010 ( S.I. No. 573 of 2010 ) in order to give effect to Commission Directive 2014/100/EU which amends Directive 2002/59/EC establishing a Community vessel traffic monitoring and information system, by replacing the text of Annex III in the earlier Directive with the text in the Annex to the later Directive.
