S.I. No. 492/2016 - European Union (Beef Producer Organisations) (Amendment) Regulations 2016 .


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 23rd September, 2016.

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving effect to Chapter III of Title II of Part II of Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 20131 in so far as it relates to beef and veal, hereby make the following regulations:

1. These Regulations may be cited as the European Union (Beef Producer Organisations) (Amendment) Regulations 2016.

2. The European Union (Beef Producer Organisations) Regulations 2016 ( S.I. No. 49 of 2016 ) are amended—

(a) in Regulation 2 by substituting for subparagraph (a) of the definition of “authorised officer” the following—

“(a) a person appointed under Regulation 9, or”,

(b) in Regulation 4 by substituting for paragraph (2) the following—

“(2) The Minister may from time to time publish the register established under Regulation 3 or such extract as the Minister considers appropriate.”, and

(c) in Regulation 15 by substituting for paragraph (1) the following—

“(1) A person who fails to comply with Regulation 4(5), Regulation 5 or Regulation 14 commits an offence and is liable on summary conviction to a class A fine.

(1A) The Minister may prosecute an offence in a summary manner.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations give effect to Chapter III of Title II of Part II of Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 20131 in so far as it relates to beef and veal. These Regulations amend the Statutory Instrument 49 of 2016 in the manner specified in these Regulations.
