S.I. No. 145/2018 - Animal Health and Welfare (Export) Regulations 2018


I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 63 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following regulations:

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th May, 2018.

1. These Regulations may be cited as the Animal Health and Welfare (Export) Regulations 2018.

2. In these Regulations-

“Animal Identification and Movement system” means the computerised database referred to in Regulation 3(3)(b) of the European Communities (Identification of Bovines) Regulations 2009 ( S.I. No. 77 of 2009 );

“food business operator” means a food business operator approved in accordance with regulation 4 of the European Communities (Food and Feed Hygiene) Regulations 2009 ( S.I. No. 432 of 2009 ).

3. These Regulations apply to bovines.

4. The Minister may provide a food business operator access to data held on the Animal Identification and Movement system to verify the disease status and eligibility of an animal or animal product destined for the export market.

5. A Food Business Operator shall not exportto a third countryan animalor animalproduct where the export conditions require the animalor animal producttomeet certain criteriain relation to notifiable diseases,without first verifyingthattheanimalor animal productis eligible for exporton the Animal Identification and Movement system.

6. Regulation 5 is a penal provision to which section 63 (5)(a) of the Animal Health and Welfare Act 2013 (No. 15 of 2013) applies.
