S.I. No. 576/2018 - European Communities (Organisation of Working Time) (General Exemptions) (Amendment) Regulations 2018


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th January, 2019.

I, REGINA DOHERTY, Minister for Employment Affairs and Social Protection, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 93/104/EC of 23 November 19931 as amended by Directive 2000/34/EC of the European Parliament and of the Council of 22 June 20002 (as consolidated in Directive 2003/88/EC of the European Parliament and of the Council of 4 November 20033 ), hereby make the following regulations:

Citation

1. (1) These Regulations may be cited as the European Communities (Organisation of Working Time) (General Exemptions) (Amendment) Regulations, 2018.

(2) The Principal Regulations and these Regulations may be cited together as the European Communities (Organisation of Working Time) (General Exemptions) Regulations 1998 and 2018 and shall be construed together as one.

Commencement

2. These Regulations shall come into operation on the 19th day of December, 2018.

Definitions

3. “Principal Regulations” means the Organisation of Working Time (General Exemptions) Regulations 1998 ( S.I. No. 21 of 1998 ).

Amendment of Schedule to Principal Regulations

4. Paragraph 3 (ix) of the Schedule to the Principal Regulations is amended by the substitution of “agriculture, including, inter alia, the caring for or the rearing or the breeding or training of racehorses;” for “agriculture”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations clarify that the term “agriculture” in the Schedule to the Organisation of Working Time (General Exemptions) Regulations 1998 ( S.I. No. 21 of 1998 ), includes, inter alia, “the caring for or the rearing or the breeding or training of racehorses” for the purpose of those Regulations.
