S.I. No. 73/2019 - Public Service Pay and Pensions Act 2017 (Payments in respect of Certain Medical Certification and Reports under the Social Welfare Consolidation Act 2005) Regulations 2019


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th March, 2019.

I, REGINA DOHERTY, Minister for Employment Affairs and Social Protection, in exercise of the powers conferred on me by section 42 of the Public Service Pay and Pensions Act 2017 (No. 34 of 2017), being satisfied that subsection (6) of that section has been complied with; having complied with subsection (9) of that section; having had regard to the matters specified in paragraphs (a) to (e) of subsection (10) of that section; with the consent of the Minister for Public Expenditure and Reform, hereby make the following Regulations:

Citation and commencement

1. (1) These Regulations may be cited as the Public Service Pay and Pensions Act 2017 (Payments in respect of Certain Medical Certification and Reports under the Social Welfare Consolidation Act 2005) Regulations 2019.

(2) These Regulations shall come into operation on 1 March 2019.

Definitions

2. In these Regulations—

“Act of 2005” means the Social Welfare Consolidation Act 2005 (No. 26 of 2005);

“service provider” means a medical practitioner who provides certain medical certificates and reports, as the case may be, in respect of persons in their medical care to the Minister for Employment Affairs and Social Protection;

“certain medical certification and reports” means those medical certificates and reports as may be required for the purposes of the Act of 2005, the regulations made thereunder and any schemes administered by the Minister, in such form and containing such particulars as the Minister may from time to time require.

Application

3. These Regulations shall apply to payments in respect of services rendered by a service provider to the Minister for Employment Affairs and Social Protection.

Fees

4. The amounts of the payments specified in column 3 of the Schedule opposite the mention of the services specified in column 2 of that Schedule shall be payable to a service provider in respect of the services rendered by the service provider from 1 March 2019.

SCHEDULE

Medical certificates and reports as may be required for the purposes of the Act of 2005, the regulations made thereunder and any schemes administered by the Minister, in such form and containing such particulars as the Minister may from time to time require.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations set the payment levels in respect of services in connection with medical certification and the preparation of medical reports rendered by a general practitioner to the Department of Employment Affairs and Social Protection. The new fee structure takes effect from 1 March 2019.
