I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and, other than in relation to paragraph 3 of Part 2 of the Schedule to the following order, for the purpose of giving full effect to Regulation (EC) No. 437/2003 of the European Parliament and of the Council of 27 February 20031 , as amended by Commission Regulation (EC) No. 1358/2003 of 31 July 20032 (as amended by Commission Regulation (EC) No 158/2007 of 16 February 20073 ), Commission Regulation (EC) No. 546/2005 of 8 April 20054 , Council Regulation (EC) No. 1791/2006 of 20 November 20065 , Regulation (EC) No. 219/2009 of the European Parliament and of the Council of 11 March 20096 and Council Regulation (EU) No. 517/2013 of 13 May 20137 , hereby order as follows: | ||
1. This Order may be cited as the Statistics (Carriage of Passengers, Freight and Mail by Air) Order 2020. | ||
2. (1) In this Order - | ||
“Act of 1993” means the Statistics Act 1993 (No. 21 of 1993); | ||
“Annex” means Annex I to the Regulation; | ||
“Regulation” means Regulation (EC) No. 437/2003 of the European Parliament and of the Council of 27 February 20031 , as amended by Commission Regulation (EC) No. 1358/2003 of 31 July 20032 (as amended by Commission Regulation (EC) No 158/2007 of 16 February 20073 ), Commission Regulation (EC) No. 546/2005 of 8 April 20054 , Council Regulation (EC) No. 1791/2006 of 20 November 20065 , Regulation (EC) No. 219/2009 of the European Parliament and of the Council of 11 March 20096 and Council Regulation (EU) No. 517/2013 of 13 May 20137 ; | ||
“survey” means the survey that is conducted by the Central Statistics Office for the purpose of obtaining information specified in Articles 3 and 4 from authorities of airports specified in the Schedule, other than in relation to the authority of the airport specified in paragraph 3 of Part 2 thereof, including for the purpose of compliance with the Regulation. | ||
(2) A word or expression that is used in this Order and is also used in the Regulation has, unless the contrary intention appears, the same meaning in this Order as it has in the Regulation. | ||
3. (1) A requirement on an airport authority that manages an airport referred to in Part 1 of the Schedule to provide, for the purposes of the survey, information in relation to the airport in accordance with Tables A and B of the Annex is prescribed for the purposes of section 25 of the Act of 1993. | ||
(2) The airport authorities in relation to whom a requirement to provide information is prescribed in paragraph (1) shall provide the relevant information - | ||
(a) where the information relates to December 2019, once only, and | ||
(b) monthly, and in relation to the immediately preceding month in the period from February 2020 to December 2024. | ||
4. (1) A requirement on an airport authority that manages an airport referred to in Part 1 or 2 of the Schedule to provide, for the purposes of the survey, information in relation to the airport in accordance with Table C of the Annex is prescribed for the purposes of section 25 of the Act of 1993. | ||
(2) The airport authorities in relation to whom a requirement to provide information is prescribed in paragraph (1) shall provide the relevant information - | ||
(a) where the information relates to 2019, once only, and | ||
(b) annually, and in relation to the immediately preceding year, in the period 2021 to 2024. | ||
