S.I. No. 205/2020 - Road Vehicles (Registration and Licensing) (Amendment) Regulations 2020


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 9th June, 2020.

I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by sections 19 and 21 of the Finance (No. 2) Act 1992 (No. 28 of 1992) (as adapted by the Housing, Planning, Community and Local Government (Alteration of Name of Department and Title of Minister) Order 2017 (S.I. No. 358 of 2017)) and the Motor Tax (Transfer of Departmental Administration and Ministerial Functions) Order 2017 (S.I. No. 601 of 2017), hereby make the following regulations:

1. These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations 2020.

2. Article 8 of the Road Vehicles (Registration and Licensing) (Amendment) (No. 2) Regulations 1992 ( S.I. No. 409 of 1992 ) is amended -

(a) by the substitution of the following sub-article for sub-article (2):

“(2) A trade licence may be used by a person other than the motor trader to whom it was issued where the vehicle is being used -

(a) in the course of employment by an employee, where he or she is authorised by the motor trader to use the vehicle, or

(b) for the purpose of test or trial by a prospective purchaser with the knowledge and consent of -

(i) the motor trader, or

(ii) an employee who is authorised by the motor trader to consent to the test or trial of vehicles.”,

and

(b) by the insertion of the following sub-article after sub-article (2):

“(3) In this Article “employee” means a person employed by the motor trader to whom the trade licence was issued.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations provide for trade licence holders to allow prospective buyers to test drive vehicles without the requirement for the trade licence holder or an employee to also be physically present in the vehicle.
