I, HELEN MCENTEE, Minister for Justice and Equality, in exercise of the powers conferred on me by section 35 of the Prisons Act 2007 (No. 10 of 2007) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 138 of 2011 ), and with the approval of the Government, hereby make the following rules: | ||
1. (1) These Rules may be cited as the Prison (Disciplinary Code for Officers) (Revocation) Rules 2020. | ||
(2) These Rules come into operation on 1 October 2020. | ||
2. Subject to Rule 3, the following are revoked: | ||
(a) the Prison (Disciplinary Code for Officers) Rules 1996 ( S.I. No. 289 of 1996 ); | ||
(b) the Prison (Disciplinary Code for Officers) (Amendment) Rules 2009 ( S.I. No. 438 of 2009 ). | ||
3. Where, before the date on which these Rules come into operation, an allegation against an officer of a breach of discipline has been made under Rule 7 of the Prison (Disciplinary Code for Officers) Rules 1996 ( S.I. No. 289 of 1996 ) (“revoked Rules”) and, by that date, the allegation has not been dealt with, the allegation shall continue to be dealt with under the revoked Rules. | ||
The Government approve of the making of the foregoing Rules | ||
