STATISTICS (CONSUMER PRICE SURVEY) ORDER 2022 | ||
I, MICHEÁL MARTIN, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993), and, in relation to Article 4 of the following order (insofar as it relates to a product as defined in paragraph (a) of the definition of “product” in Article 2(1) thereof), for the purpose of giving full effect to Regulation (EU) 2016/792 of the European Parliament and of the Council of 11 May 20161 , hereby order as follows: | ||
1. This Order may be cited as the Statistics (Consumer Price Survey) Order 2022. | ||
2. (1) In this Order - | ||
“direction” means a direction under section 26 of the Statistics Act 1993 (No. 21 of 1993) made pursuant to the requirement prescribed under Article 4; | ||
“home loan” means any loan or advance or any other arrangement whatever by virtue of which interest is paid or payable, which, without having been used for any other purpose, is used by an individual solely for the purpose of defraying money employed in the purchase of a qualifying residence or in paying off another loan used for such purpose; | ||
“product” means - | ||
(a) a product within the meaning of the Regulation, and | ||
(b) a product specified in Schedule 2; | ||
“qualifying residence” means a residential premises situated in the State, which is used as the sole or main residence of - | ||
(a) an individual, | ||
(b) a former or separated spouse of an individual, or a former civil partner or a civil partner from whom the individual is living separately in circumstances where reconciliation is unlikely, or | ||
(c) person who, in relation to an individual, is a dependent relative, and which is, where the residential premises is provided by the individual, provided rent-free and without any other consideration; | ||
“Regulation” means Regulation (EU) 2016/792 of the European Parliament and of the Council of 11 May 20161 ; | ||
“survey” means the Consumer Price Survey conducted by the Central Statistics Office for the purposes of obtaining information referred to in Schedule 1, including for the purposes of compliance with the Regulation. | ||
(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires. | ||
3. This Order applies to an undertaking that is classified for statistical purposes under any section of NACE Rev. 2, as set out in Annex I to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20062 , as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 20083 , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 20124 and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 20195 . | ||
4. A requirement on undertakings to which this Order applies - | ||
(a) subject to paragraph (b), to provide, for the purposes of the survey, information the general nature of which is specified in Schedule 1, and | ||
(b) to provide the information referred to in paragraph (a) monthly in the period from December 2022 to November 2027 and in relation to the month concerned, is hereby prescribed. | ||
SCHEDULE 1 | ||
1. Information regarding the following, as it relates to such product sold by the undertaking concerned as is specified in the notice of the direction concerned, and specifying the month to which the information relates: | ||
(a) the purchase price of the product on such day of the month as is specified in the notice; | ||
(b) the average purchase price of the product on such day of the month as is specified in the notice; | ||
(c) the quantity sold of the product on such day of the month as is specified in the notice; | ||
(d) the unit of measurement for the purchase price of the product; | ||
(e) the characteristics of the product; | ||
(f) the taxes and excise duties levied on the product; | ||
(g) the terms of sale of the product. | ||
2. Information regarding - | ||
(a) the type of home loans provided by the undertaking, by reference to the method by which the interest payable by virtue of the home loan is calculated, and | ||
(b) in relation to each type of home loan referred to in paragraph (a), the average rate of interest charged, on such day of the month as is specified in the notice of the direction concerned, by the undertaking by virtue of home loans of that type. | ||
3. Information regarding - | ||
(a) the subscriptions charged by an undertaking that is a trade union, in respect of membership of the trade union, by reference to the period of membership to which the subscriptions relate, and | ||
(b) the method of calculation of the subscriptions referred to in paragraph (a). | ||
SCHEDULE 2 | ||
(a) Building materials; | ||
(b) Insurance policy in respect of contents of a dwelling; | ||
(c) Insurance policy in respect of a dwelling; | ||
(d) Insurance policy in respect of a motor car. | ||
