I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 9 (2)(b) of the Health Insurance (Amendment) Act 2021 (No. 47 of 2021), hereby order as follows: | ||
1. This Order may be cited as the Health Insurance (Amendment) Act 2021 (Commencement) Order 2023. | ||
2. The 1st day of April 2023 is appointed as the day on which the Health Insurance (Amendment) Act 2021 (No. 47 of 2021) shall, in so far as it is not already in operation, come into operation. | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
This Order appoints 1 April 2023 as the date on which paragraphs (b) and (c) of section 5 of the Health Insurance (Amendment) Act 2021 come into operation. The amendment introduces a time limit on the period in which risk equalisation credits can be claimed by health insurers from the Risk Equalisation Fund. It sets out that claims cannot be made to the Health Insurance Authority if entitlement to claim (or part thereof) arose more than six years before the 31 March in the year prior to the date of making the claim. |
