S.I. No. 525/2023 - Criminal Justice (Miscellaneous Provisions) Act 2023 (Commencement) (No. 2) Order 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd November, 2023.

I, HELEN MCENTEE, Minister for Justice, in exercise of the powers conferred upon me by section 1 (5) of the Criminal Justice (Miscellaneous Provisions) Act 2023 (No. 24 of 2023), hereby order as follows:

1. This Order may be cited as the Criminal Justice (Miscellaneous Provisions) Act 2023 (Commencement) (No. 2) Order 2023.

2. In this Order, “Act of 2023” means the Criminal Justice (Miscellaneous Provisions) Act 2023 (No. 24 of 2023).

3. The 1st day of November 2023 is appointed as the day on which the following provisions of the Act of 2023 shall come into operation:

(a) Part 1 (insofar as it is not already in operation);

(b) Part 2;

(c) Part 4 (other than insofar as subparagraph (i) of subsection (3)(j) of section 10 of the Non-Fatal Offences against the Person Act 1997 (No. 26 of 1997) amended by section 23 relates to Part 5 of the Act of 2023);

(d) Part 6;

(e) Part 8;

(f) section 60, other than the following provisions of paragraph (a):

(i) subparagraph (ii), and

(ii) subparagraph (iii), insofar as it relates to the insertion, in paragraph (e) of the definition of “relevant offence” in section 12 (1) of the Criminal Evidence Act 1992 (No. 12 of 1992), of a reference to paragraph (db) of that definition;

(g) sections 63, 64, 66 to 68, 70, 72, 73, 75, 76 (other than paragraph (d)), 77, 79, 80, 81, 82(b), 83 to 85 and 87.
