S.I. No. 618/2023 - Nursing Homes Support Scheme Act 2009 (Modification of Assessment of Eligible Rental Income) Order 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 8th December, 2023.

WHEREAS the Minister for Health and the Minister for Housing, Local Government and Heritage have made a request under subsection (1) of section 45D of the Nursing Homes Support Scheme Act 2009 (No. 15 of 2009);

Now the Government, considering it appropriate to do so having had regard to that request and to a report prepared under subsection (2) of section 45C of the Nursing Homes Support Scheme Act 2009 , in exercise of the powers conferred on them by subparagraph (i) of paragraph (a) of subsection (1) and by subsection (4) of section 45D of that Act, hereby order as follows:

1. This Order may be cited as the Nursing Homes Support Scheme Act 2009 (Modification of Assessment of Eligible Rental Income) Order 2023.

2. In this Order, “Principal Act” means the Nursing Homes Support Scheme Act 2009 (No. 15 of 2009).

3. With effect from 1 February 2024 –

(a) in paragraph 2A of Part 1A of Schedule 1 to the Principal Act –

(i) step I shall have effect as if “0 per cent” were substituted for “40 per cent”, and

(ii) step K (so far as relating to the amount produced by step F) shall have effect as if “100 per cent” were substituted for “60 per cent”,

(b) step K of paragraph 2A of Part 2A of Schedule 1 to the Principal Act shall have effect as if “0 per cent” were substituted for “20 per cent”, and

(c) step M of paragraph 2A of Part 2A of Schedule 1 to the Principal Act (so far as relating to the amount produced by step H) shall have effect as if “100 per cent” were substituted for “80 per cent”.
