I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by sections 4 , 5 (amended by section 3 of the Misuse of Drugs (Amendment) Act 2016 (No. 9 of 2016)), 18 and 38 of the Misuse of Drugs Act 1977 (No. 12 of 1977), hereby make the following regulations: | ||||||
1. (1) These Regulations may be cited as the Misuse of Drugs (Amendment) Regulations 2024. | ||||||
(2) The Principal Regulations, the Regulations of 2019, the Misuse of Drugs (Amendment) Regulations 2020 ( S.I. No. 99 of 2020 ), the Misuse of Drugs (Amendment) Regulations 2022 ( S.I. No. 210 of 2022 ), the Misuse of Drugs (Amendment) Regulations 2023 ( S.I. No. 150 of 2023 ), the Misuse of Drugs (Amendment) (No. 2) Regulations 2023 ( S.I. No. 156 of 2023 ) and these Regulations may be cited together as the Misuse of Drugs Regulations 2017 to 2024. | ||||||
2. In these Regulations— | ||||||
-“Principal Regulations” means the Misuse of Drugs Regulations 2017 ( S.I. No. 173 of 2017 ); | ||||||
“Regulations of 2019” means the Misuse of Drugs (Amendment) Regulations 2019 ( S.I. No. 282 of 2019 ). | ||||||
3. Schedule 2 (as amended by Regulation 4 of the Regulations of 2019) to the Principal Regulations is amended, in paragraph 6, by substituting “Lisdexamfetamine” for Lisdexamphetamine”. | ||||||
4. Part 5 of Schedule 8 to the Principal Regulations is amended by inserting after the entry for “Methylphenidate” the following entry: | ||||||

EXPLANATORY NOTE | ||||||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||||||
The purpose of these Regulations is to amend the Misuse of Drugs Regulations 2017 to insert Lisdexamfetamine into Schedule 8, Part 5, to allow registered nurses and registered midwives to prescribe Lisdexamfetamine for use in mental health or intellectual disability care. | ||||||
These Regulations may be cited as the Misuse of Drugs (Amendment) Regulations 2024. |
