Notice of the making of this Statutory Instrument was published in | ||

I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993), for the purpose of giving full effect to Commission Regulation (EU) 2021/1901 of 29 October 20211 , hereby order as follows: | ||
1. This Order may be cited as the Statistics (Income of Private Hospitals Survey) Order 2024. | ||
2. (1) In this Order - | ||
“medical provider” includes - | ||
(a) a registered medical practitioner within the meaning of the Medical Practitioners Act 2007 (No. 25 of 2007), | ||
(b) a registered dentist within the meaning of the Dentists Act 1985 (No. 9 of 1985), and | ||
(c) a registered pharmacist within the meaning of the Pharmacy Act 2007 (No. 20 of 2007); | ||
“private hospital” means a hospital (including an approved centre within the meaning of section 63 of the Mental Health Act 2001 (No. 25 of 2001)) which - | ||
(a) provides healthcare, and | ||
(b) is not a publicly-funded hospital, | ||
and includes a private hospital where arrangements have been or may be made for the provision of services for a public patient by agreement with the Health Service Executive; | ||
“public sources” includes - | ||
(a) the Health Service Executive, | ||
(b) a Department of State, | ||
(c) the National Treatment Purchase Fund Board established under the National Treatment Purchase Fund Board (Establishment) Order 2004 ( S.I. No. 179 of 2004 ), and | ||
(d) a health authority of another state; | ||
“publicly-funded hospital” means a hospital which provides services to a person pursuant to his or her entitlement under Chapter II of Part IV of the Health Act 1970 (No. 1 of 1970); | ||
“Regulation” means Commission Regulation (EU) 2021/1901 of 29 October 2021; | ||
“survey” means the Income of Private Hospitals Survey conducted by the Central Statistics Office for the purposes of obtaining from private hospitals the information specified in the Schedule for the purposes of compliance with the Regulation. | ||
(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where defined otherwise in this Order. | ||
3. This Order applies to a private hospital in the State. | ||
4. A requirement on a private hospital to which this Order applies to provide, once only and for the purposes of the survey, information the general nature of which is specified in the Schedule, in relation to each year in the period from 2021 to 2027, is hereby prescribed. | ||
5. The Statistics (Income of Private Hospitals) Order 2021 ( S.I. No. 705 of 2021 ) is revoked. | ||
SCHEDULE | ||
Article 4 | ||
1. Information in accordance with the private hospital’s audited financial statements, regarding the following, as it relates to the private hospital concerned during the year requested: | ||
(a) detailed income and expenditure; | ||
(b) income from public sources; | ||
(c) income from private health insurers; | ||
(d) income from patient contribution (classified by care type and excluding income from patients’ private health insurance); | ||
(e) income from charitable sources; | ||
(f) income from private sources; | ||
(g) income from bequests; | ||
(h) income from medical providers for use of the private hospital’s facilities; | ||
(i) surplus of income over costs and expenditure; | ||
(j) income from other sources. | ||
2. Particulars of the time taken to complete the form, questionnaire or other record prepared by the Director General for the collection of information referred to in paragraph 1. | ||
