S.I. No. 324/2024 - Protection of Employment Act 1977 (Notification of Proposed Collective Redundancies) Regulations 2024


Notice of the making of this Statutory Instrument was published in

“Iris Oifigi il” of 2nd July, 2024.

I, PETER BURKE, Minister for Enterprise, Trade and Employment, in exercise of the power conferred on me by section 12 (2) of the Protection of Employment Act 1977 (No. 7 of 1977) hereby make the following regulations:

1. (1) These Regulations may be cited as the Protection of Employment Act 1977 (Notification of Proposed Collective Redundancies) Regulations 2024.

(2) These Regulations shall come into operation on the 1st day of July 2024.

2. In these Regulations, “Act of 1977” means the Protection of Employment Act 1977 (No. 7 of 1977).

3. The following particulars shall be specified by an employer or a responsible person in a notification under section 12 of the Act of 1977:

(a) (i) the name and address of the employer and, where applicable, of the responsible person;

(ii) contact details of the employer or responsible person;

(iii) whether the employer is a sole trader, a partnership or a body corporate;

(iv) where the employer is a body corporate, its registration number on the register (within the meaning of section 887 (2) of the Companies Act 2014 ) kept by the Registrar of Companies;

(b) the address or addresses of the establishment where the collective redundancies are proposed;

(c) the total number of persons normally employed, within the meaning of section 8 of the Act of 1977, at that establishment;

(d) the number and descriptions or categories of employees whom it is proposed to make redundant;

(e) the period during which the collective redundancies are proposed to be effected, stating the dates on which the first and the final dismissals are expected to take effect;

(f) the reasons for the proposed collective redundancies;

(g) the names and contact details of the employee representatives;

(h) the date on which consultations with the employee representatives commenced or is expected to commence and, if commenced, the progress achieved in those consultations to the date of the notification.

4. The Protection of Employment Act 1977 (Notification of Proposed Collective Redundancies) Regulations 1977 ( S.I. No. 140 of 1977 ) are revoked.
