COMMISSIONER:

1.        This is a Gordian Knot which we have to untie.  We have, and we are bound to have, the interest of C completely in mind.  We wish to have C re-united with his family particularly now that Mr L has received his punishment for the assault on C and there are no bail conditions in place.  But we are extremely concerned about Mrs L's intractability.  Clearly she doesn't like the Social Services and doesn't trust them but she wishes to have C back and to do that she must work with the system and not against it.  We are pleased to note that a kinship assessment is to be made on Mr and Mrs M (who have the care of C) and we can only hope that this will be expedited.  But we have to say this, Mrs L is making matters hard for herself, we have noted that she completely distrusts the system, that may well be but it is the system that operates in Jersey.  She has to co-operate and that is our strongest advice possible.  Mrs L must meet with the appropriate expert and with the Social Services otherwise this case will go on and on. 

2.        We are going to extend the Order for 28 days and during that time we can only hope that Mrs L, for the sake of C, will co-operate with the authorities.  We have to say this, we do not disagree that Mr and Mrs M can take C to Ireland from 22nd to 27th of January, and I have to thank every body for the way they have behaved today including Mrs L.
