    DECISION

    The unanimous decision of the tribunal is that the application be dismissed.

    Summary Reasons

  1. There was no appearance by either party. Having considered the Originating Application and the Notice of Appearance the tribunal considered it appropriate to deal with the matter in the absence of the parties.
  2. It was accepted that the applicant had been dismissed. The respondent's appearance indicated that he had been dismissed for breach of the cash handling procedures whereby he had left cash and a cheque in an unlocked desk drawer in a public area for a period of one week despite knowing that the money should have been put in the safe. The applicant, in his Originating Application had suggested that dismissal was too severe a punishment and had suggested that the dismissal was connected with his seeking to join a trade union.
  3. There was no evidence before the tribunal on the basis of which a finding could be made that the applicant had been dismissed for seeking to join a trade union. The tribunal considered that it could not be said that, in the circumstances outlined in the Notice of Appearance, and in the absence of any further evidence, that the decision to dismiss was unreasonable or excessive. In the circumstances the application fell to be dismissed.
