    THE INDUSTRIAL TRIBUNALS

    CASE REF: 87/04

    APPLICANT: Paul Eric Bowhay

RESPONDENT: CD Print & Design Ltd (In Liquidation)

    DECISION

The unanimous decision of the tribunal is that the application be dismissed.

    Appearances:

The applicant did not attend and was not represented.

The respondent did not attend and was not represented.

    Summary Reasons

  1. Neither party appeared. The applicant had completed an Originating Application seeking a redundancy payment. The application also suggested that there were outstanding wages and over-time due and raised the possibility that the applicant's pension contribution might not have been paid. While no Appearance was entered a letter from the Liquidator of the respondent company suggested that the Redundancy Payments Service had made payments to the applicant and were processing his pension payments.
  2. In the circumstances the tribunal considered it had insufficient information on the basis of which it could make any Order in favour of the applicant. Accordingly the application fell to be dismissed.
