DECISION ON A PRE-HEARING REVIEW

The decision of the tribunal is that the claim has not been presented within the time-limit set out in Article 217(5) of the Employment Rights (Northern Ireland) Order 1996, and the claim is dismissed.

The claimant was not present or represented.

The respondent was represented by Mr P Martin of Arthur Cox, Solicitors.

REASONS

1. The reasons for this decision were given orally at the conclusion of the hearing.
2. The claimant was duly notified of the date of this hearing. He was not in attendance and was not represented at the hearing. In the circumstances, I decided to dispose of the proceedings in the absence of the claimant. Prior to doing so, I considered the contents of the claimant's originating application, the contents of the Notice of Appearance which has been entered in this case, a KPMG report dated 27 January 2005, and a copy of a letter dated 19 April 2006 (which Mr Martin had sent to the claimant).
3. In the letter of 19 April, Mr Martin notified the claimant that he had instructions to apply for an order for costs against the claimant in certain circumstances. However, he has informed me, at this hearing, that no application for costs is being pursued.
