    DECISION ON A REVIEW

  1. The decision on a review of a decision issued by letter of 15 May 2006 not to accept part of the response insofar as it related to the claimant's claims of unlawful deductions from wages, right to paid annual leave, breach of Working Time Regulations is as follows:-
  2. (i) the said decision of 15 May 2006 is revoked because it is in the interests of justice to do so; and
    (ii) because it arose as the result of an administrative error.

    2. (i) The factual circumstances are set out in the respondents' representatives' letter to the tribunal of 16 May 2006. This correspondence was copied to the claimant. He did not object to the granting of a review.
         
      (ii) The respondents' counsel stated that the ground of response to the claims was that the claimant had received all leave and monies to which he was entitled.

  3. I direct that the response presented by the respondents on 5 May 2006 now be accepted as a response by the respondents to the claims of unauthorised deductions from wages, right to paid annual leave, breach of Working Time Regulations and dealt with in accordance with Rule 5(2) of the Industrial Tribunals Rules of Procedure set out in Schedule 1 of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.
