    DECISION

    The unanimous decision of the tribunal is that the claimant is entitled to a statutory redundancy payment of £1141.52p as calculated in this decision.

    The claimant had indicated to the Tribunal that she was unable to attend and did not appear.

    The respondent had entered a response to the claim but did not appear at the hearing.

  1. The claimant was born on 17 May 1980. She commenced work for the respondent on 4 February 2002 and that employment ceased on 31 October 2007.
  2. Having considered the contents of the response together with the documentation submitted by the claimant and the contents of the claim form and taking into account the statutory presumption of redundancy, the Tribunal concludes that the claimant was made redundant on 31 October 2007.
  3. The claimant's gross weekly pay was £175.62p.
  4. Working backward from the date of termination, the claimant had 4 complete years of employment in which she was not under the age of 22. The statutory multiplier in respect of each of those years is 1.5 and therefore in respect of those years the amount payable is 6 weeks gross pay. The claimant had one complete year of service during which she was below of age of 22 and therefore the statutory multiplier for that year is 0.5. The total amount payable is therefore 6 ½ weeks @ £175.62p. This produces a total of £1,141.53p and the Tribunal concludes that the claimant is entitled to payment of that amount.
  5. 5. This is a relevant decision for the purposes of the Industrial Tribunal (Interest) Order (NI) 1990.
