DECISION

 

The respondent is ordered to pay to the claimant £2,500.00 being wages which were unpaid by the respondent when it ceased trading.

The claimant presented her own claim.

 

The respondent did not appear and was not represented.

 

 

REASONS

 

1.       The claimant was employed as an Office Administrator by the respondent during July and August 2011.

 

2.       The respondent had agreed to pay the claimant £1,250.00 for each month worked but failed to pay when the respondent ceased trading on 31 August 2011.

 

3.       Article 45 of the Employment Rights (Northern Ireland) Order 1996 provides that employees have a right not to suffer unauthorised deductions by employers.  By failing to make the payments agreed, the respondent is in breach of this provision.

 

4.       The claimant is entitled to compensation of £2500.00 in respect of the unpaid wages.

 

          This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (NI) 1990.
