The unanimous decision of the tribunal is that the claimant’s claims are dismissed.

The claimant did not appear and was not represented.

The respondent did not appear and not was represented.

 

1.       The claimant has made claims for constructive unfair dismissal and breach of contract.  The respondent filed a response to the claims on 12 October 2010.  Neither party has attended at the hearing despite time being allowed by the tribunal for late attendance.  The tribunal considered the claim form and the response form.  There is insufficient information in the papers to satisfy the tribunal that it is appropriate to make findings in the claimant’s favour.  The tribunal did not have the benefit of hearing evidence from the claimant.  As the burden of proof lies with the claimant the tribunal has determined that the claimant’s claims be dismissed.
