DECISION

The decision of the tribunal is that the claimant is entitled to a statutory redundancy payment of £2,275.04, holiday pay of £504.33, unpaid wages of £94.80 and £237.00 (lying week) and statutory guarantee payments of £110.00

Appearances:

The claimant appeared in person and was not represented.

The respondent was represented by Mr M Young, Managing Director.

 

1.       The claimant was employed by the respondent from September 1999 to 12 December 2010 when he was made redundant and therefore had 11 years’ complete service.

 

2.       His gross weekly wage was £284.38 and his net weekly wage was £237.00.  He was aged 27 at the date of his redundancy.

 

3.       The claimant was contractually entitled to 29 days paid leave and the leave ran from 1 January to 31 December.  The claimant had taken 17 days paid leave in 2010.

 

4.       The claimant was not paid for two days work in September 2010.

 

5.       The claimant did not receive five days statutory guarantee payment of £110.00.

 

6.       The claimant did not receive payment for one lying week.

 

7.       The claimant is entitled to a statutory redundancy payment calculated as follows:-

 

                    £284.38 x 8                                 =                                      £2,275.04

 

8.       The claimant is entitled to holiday pay calculated as follows:-

 

                    348/365 x 29               =                  27.64 days entitlement to 12 December

 

                    Less 17 days taken =                  10.64 days entitlement

 

                    Net daily pay           =                  £47.40

 

                              £47.40 x 10.64                  =                                      £   504.33

 

9.       The claimant is also entitled to two days net pay for the unpaid work in September totalling £94.80 and a statutory guarantee payment amounting to £110.00.

 

10.     This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
